MEDEALIS PRODUCT WARRANTY
QUALITY WITHOUT COMPROMISE
Manufactured in accordance with the strict Quality Control standards required to maintain ISO 13485 status, the Medealis products are guaranteed to meet or exceed your expectations as well as those of your patients. As a testament to our world class quality control, all Medealis components are subject to a 100% Satisfaction Guarantee. This includes a 3 year guarantee on Medealis abutments and a 30 year guarantee on all third-party implants used in conjunction with Medealis abutments, subject to the terms and conditions detailed in this document.
1.Scope
This guarantee (the “MEDEALIS Guarantee” as defined below) from MEDEALIS GmbH (“MEDEALIS”) applies to the products listed below and in favor of the attending physician/dentist only (the “User”). Third parties, particularly patients or intermediate suppliers, may not derive any rights from this MEDEALIS Guarantee. The MEDEALIS Guarantee covers the replacement of Medealis products and third-party implants used in conjunction with Medealis abutments (“Third-Party Implants”) as defined in Section 2.
The MEDEALIS Guarantee only covers the replacement of Medealis Products and Third-Party Implants and not any associated costs, including but not limited to chair time, lab fees and any other associated treatment. Abutments and implants are subject to a processing fee of €10 which will be invoiced upon replacement.
2. Medealis Products and Third-Party Implants Covered by the MEDEALIS Guarantee
The MEDEALIS Guarantee covers the replacement of abutments and ancillary components belonging to the Medealis Product portfolio for the duration of three (3) years from their date of purchase. This includes titanium abutments, laboratory transfer components as well as tools and drivers, which will be replaced with equivalent components. Regularly consumable components such as lab processing and retention inserts are not covered by the MEDEALIS Guarantee. Third-Party Implants restored with a Medealis abutment are covered for a duration of thirty (30) years from the date of placement and will be replaced with an equivalent implant.
All product replacements are subject to the terms and conditions defined in Section 3.
3. Terms and Conditions
MEDEALIS hereby guarantees that, if any Medealis Product is defective as a result of a failure of the material strength and stability of the Medealis Product during the guarantee periods defined in Section 2, MEDEALIS will replace the Medealis Product with the same or substantially equivalent product as set forth in Section 2. The guarantee period for Medealis Products commences upon the purchase of the products and the guarantee period for Third-Party Implants commences from their date of placement by the User. Provided, however, that the following guarantee conditions are individually met and documented:
| 3.1 | Return or shipment of the products in question to MEDEALIS in sterilized or disinfected condition |
| 3.2 | Compliance with and application of instructions (in the Instructions for Use among others) valid at the time of treatment as well as recognized dental procedures, during and after the treatment. |
| 3.3 | Good oral hygiene of the patient as monitored by the User. |
| 3.4 | No guarantee case resulting from an accident, a trauma or any other damage caused by the patient or a third party. |
| 3.5 | Filing of a completed and signed Warranty Claim Form no later than 90 days after a guarantee case arises. |
| 3.6 | Medealis abutments were not used for immediate restoration. |
| 3.7 | The failure of Third-Party Implants was not a result of material or manufacturing defects. |
| 3.8 | The failure of Medealis Products or Third-Party Implants is not a result of contraindications such as alcoholism, diabetes, smoking or drug addiction. |
| 3.9 | The Third-Party Implant manufacturer has refused to honor their warranty as a result of restoration with a Medealis Product. |
4. Limits and Limitations
This MEDEALIS Guarantee is the only guarantee provided by MEDEALIS and shall apply in addition to any warranty rights conferred under any written sales agreement executed by MEDEALIS. The User remains free to claim rights against his supplier. EXCEPT AS SET FORTH HEREIN AND IN A WRITTEN SALES AGREEMENT EXECUTED BY MEDEALIS, MEDEALIS HEREBY DISCLAIMS ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO MEDEALIS PRODUCTS, SERVICES OR INFORMATION, INCLUDING, BUT NOT LIMITED TO, ANY WARRANTY OF FITNESS FOR PURPOSE OR MERCHANTABILITY, OR NON-INFRINGEMENT OF THIRD PARTY RIGHTS, OR ANY WARRANTY BY COURSE OF PERFORMANCE OR OTHERWISE.
MEDEALIS SHALL NOT BE LIABLE TO THE CUSTOMER, THE USER, THE PATIENT, OR ANY THIRD PARTY, FOR LOST EARNINGS OR PROFITS, DIRECT OR INDIRECT DAMAGES AS WELL AS COLLATERAL, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, DIRECTLY OR INDIRECTLY RELATED TO MEDEALIS PRODUCTS, SERVICES, OR INFORMATION.
This MEDEALIS Guarantee applies worldwide to Medealis Products sold by MEDEALIS, a MEDEALIS affiliated company or an official MEDEALIS distributor on or after October 1, 2020.
MEDEALIS may modify or terminate this MEDEALIS Guarantee at any time in whole or in part. Changes to, or the termination of the MEDEALIS Guarantee, will not affect the warranty given for Medealis Products purchased prior to the date of the change or termination.
